CE Mark is not required for the following groups of products:

  • Chemicals (REACH);
  • Cosmetics;
  • Packaging and packaging waste;
  • Pharmaceuticals;
  • Foods.

Non-food products which do not fall within the scope of the directives and regulations of the CE Mark may be subject to the General Product Safety Directive (2001/95/EC) which requires safety of products but does not require any marks.

General Product Safety Directive 2001/95/EC (GPSD) covers all the products which are not covered by the Directives which define the procedures with the right of application of the CE Mark, but which require a certain level of safety regulation. These products may also be regulated at the national level of the member states of the European Union. Directive 2001/95/EC covers such items as furniture, household appliances (not electric ones), sports equipment, baby products, and smaller manual instruments. The products must be safe for application during a reasonably defined period of operation. The products which fall within the scope of the General Product Safety Directive do not require CE Mark. Application of the CE Mark on the products that are not covered by the above-mentioned Directives is a violation of the harmonized EU legislation.
