The Declaration of Conformity is a document where the manufacturer certifies that the products supplied comply with the requirements of the regulatory documents.

Differences between the Declaration of Conformity and the Certificate of Compliance are the following:

  1. The Declaration of Conformity, in contrast to the Certificate of Compliance, may be executed only on a mandatory basis. You cannot obtain the Declaration of Conformity for products that are not specified in the Unified List of Products to Be Verified for Compliance in the Form of Issuing the Declaration of Conformity.
  2. There is no standard form provided for the Declaration of Conformity of products. The Declaration of Conformity is issued in A4 size paper and affixed by the seal of the applicant organization.
  3. The applicant organization shall be responsible for the information stated in the Declaration of Conformity, while both the certification authority that issued this Certificate and the applicant organization shall be responsible for the information stated in the Certificate of Compliance (both mandatory and voluntary).

We owe two forms of verification of conformity to the European Union, which for long has been practicing application of an appropriate form of conformity based upon assessment of the level of potential hazard of products: the most dangerous groups of products undergo mandatory certification by accredited certification bodies, while compliance of less dangerous products may be declared by the manufacturer (manufacturer's representative) or the seller.

The products subject to Declaration of Conformity are specified in Government Resolution No 982 On Approval of the Unified List of Products to Be Verified for Compliance in the Form of Issuing the Declaration of Conformity.

The Declaration of Conformity should be registered by an accredited certification body in accordance with the National Product Classification Code , (OKP code) assigned to this product. Any of the following documents may act as the basis for registration of the Declaration of Conformity:

  • State Registration Certificate;
  • Fire Safety Certificate;
  • Registration Certificate of the Ministry of Health of the Russian Federation.

The following information should be reflected in the Declaration of Conformity:

  • Name and address of the manufacturer;
  • Name of the normative document (GOST) to be complied with (TS, IS);
  • Laboratory test reports;
  • Veterinary document (for products of animal origin).

The accredited certification body which registers the Declaration of Conformity should assign its registration number with the code of the certification body and the serial number of the Declaration of Conformity.

The Declaration of Conformity has legal force on a par with the Certificate of Compliance and is valid on the entire territory of the Russian Federation.

Types of Declarations of Conformity in the Russian Federation

Upon approval of new Technical Regulations for certain types of products or equipment, the Declarations of Conformity with these Technical Regulations should be executed as the governing document. Each Technical Regulations are supported with a list of products to be declared or certified. Thus, the Declarations may be divided into two basic types:

  1. Declaration of Conformity with GOST R
  2. Declaration of Conformity with the Technical Regulations of the Customs Union

These documents do not have any fundamental difference. Perhaps, the main difference between them is the normative document to be complied with when testing the products. In the GOST R system, the document should be drawn up taking into account compliance with a certain GOST. When registering the Declaration of Conformity with the Technical Regulations of the Customs Union, the object safety is verified for compliance with particular Technical Regulations of the CU.
